Question:

My boyfriend is not the biological father of his ex's child can she still get child support from him?

My boyfriend was with his ex for 91/2 years. ( they were never married). She was pregnant when they met. Him and I have now been together for almost three years and I was wondering could she try and get child support for her child even though they weren't married and he isn't the biological father?

  1. No.. he has no legal responsibility for the child.  Why would you even ask that if you've been with him 3 years... if the ex was entitled to money don't you think she wouldn't wait 3 years to try and get it?


  2. Only if he legally adopted the child and accepted paternity. other than that he is not held responsible for the child's needs. But please tell your brother that it would be honorable for him to see to the needs of the child if no man is available , don't just abandon the child if he has been in his life for any length of time. we have so many children that need positive male images , believe it or not it makes a difference.

He could but probably shouldn't.  It could throw custody of the child into dispute and he could lose the child.  I'm assuming they figured things out without the court, since they weren't married and he ended up with the kid.  Trying to get child support destroys the status quo, so he should be reasonably sure he'll get something better rather than worse out of this before he goes to court.

  10. nope, not unless he was stupid enough to let her put his name on the birth certificate, then he'll have to prove he's not the father to get out of paying child support.

  11. If your bf put his name on the child's birth certificate saying he ACCEPTS complete responsibility for the child whether or not the child is his, then YES he can be made to pay child support.

    When my husband and I were married 25 years ago, this is the very same situation we experienced. We paid child support too. So from experience I can tell you Yes, this can happen.
