My boyfriend renewed his H1B and is going to Jordan to get it stamped end of September.?

Question

We want to stop in Paris on our way to attend a friends wedding. Do you know if my boyfriend can apply for the Schengen visa to France although he currently does not have a US visa in his passport (it will be in there after the trip). He is not out of status as he has his I-797 allowing him to be in the US at the moment .

My question is, would the I-797 + flight ticket to Jordan be sufficient proof that he does not intend to stay in France and therefore can be granted a Schengen visa for the 4 days we want to spend in Paris?

Is his current visa expired? Where is he from I assumed that he was from Jordan if this is where he is going to get his visa stamped there.
