My boyfriend was arrested today?

he was on parole after serving a sentence of 4 years ..... he and another guy who is also on parole butted heads and had an altercation with each other over a stolen ipod. This argument happened in the state of California and since he's on parole, he's got rules he must follow or be incarcerated ..... for 6 months he followed all the required restrictions, but today he failed & he's in the holding tank now.

I'm just curious how long he'll he be serving time in jail ?

there is no bond according to the county inmate information.

Does anyone here know such instances ?

Please help me learn...... thank you

  1. Unfortunately depending on the actual charges filed he could serve up to 2 years. Tell him to be careful because eventually the "Three Strikes" rule will get him. Good luck.


  2. We could give you a pile of legal information, but that won't solve your problem.  Here's what will:  Dump this moron immediately.  Don't call him.  Hang up if he calls you.

Unfortunately a Felon doing 4 yrs. and coming out of Prison doesn't have any managing skills, therefore the odds are so against them and they usually go back to what they have learned to survive in Prison which is "Battle".  It's too bad the Parole Officer didn't send him right into counseling to aquire some normal life skills.  In fact I wish it was mandatory to fullfill a certain amount of hours in a special counseling program for Felons because allot of them being incarcerated only teaches them boundaries within the confines of Prison, not on the outside, so they continue with what they know which is survival instead of perseverance.  Now, call a bail bonds, see what his bail is, if you can bond him out, get him back to work immediately so he can pay for a real Attorney to plead his case.  No State appointed Attorney will fight for him, they work hand in hand with the Prosecutor's and will help send him up the river again.  You call around pronto for a decent Attorney while he's working, gather up as much as possible such as the Police Report (get your copy), letters from witnesses, anything that's an asset to pleading his defense and stick to the Attorney like glue.  He has enough time to work and pay for the Attorney, tell him to get two jobs if he has too!  If he wants you bad enough, he'll do what he needs to do to fix this.  Also, if he can't be bonded, call the jail for his visiting schedule and go see him with the plan and two heads are better then one.  Remember, no appointed Attorney will get him out of this! So get to work, you are probably all he has and he has lost most of his rights behind those bars. So speak for him (if you intend to keep him).  Criminals are allot of work and exhausting, if you have the energy and he's worth saving, go for it.  Hopefully, it wasn't your boyfriend who stole the ipod?

  4. Nobody could really say to be honest with you.

    No bond means super serious. 4 years prior means so as well. It might work out but odds are he will be going back to jail..... for a good amount of time.

    The big problem is that he was associating with those who are also on probation. Add in fighting over an Ipod...... something not worth going back to jail for. Bad news.

  5. No one knows. just relax and hope for the best. Lots of things can go wrong in this situation. in the end its up to the judge.

  6. I don't know all the regs, it will ultimately be up to the judge.

    Usually, when in violation of parole, the offender is sent back to prison/jail to finish out the rest of sentence or until up for parole again.

    Example:  4 year sentence, served 6 months. Straight arrow for 6 months. 6 months plus 6 months is one year of 4 year sentence. Could be sent back for the other 3 years or until paroled again.

  7. More than likely he'll be serving one to 2 more years in jail/prison.  

    It's crazy how our system is set up to fail .  Prisoners aren't out long cause the rules are stringent while out on parole.  It's hard enough for us regular citizens minding all the laws of the land.  I can't imagine how difficult it must be for a person with high testosterone to manage with these new froo froo laws.

    Loving someone who is being held in jail/prison is a heart breaking time in ones life.  Your either in it for the long haul or pull out soon.

    Since he's your boyfriend and not your husband, I suppose you could move on & meet someone new or stand fast and support this man of yours.  

    Obviously he needs you now more than ever.

  8. There is not bond because he most likely isn't charged with a new crime.  They don't need to go through the trouble of that because unless the new offense is serious they can just revoke his probation with a hearing and send him  back to jail.

    As for how long.  Well, how ever much probation time he got.  The six months won't matter.  You either finish probation without getting into trouble or you don't.  If you don't finish then you don't get time off the sentence for the time you were good.  Like if you have two years probation and one year and 11 months into it you do something stupid, well, you go do the 2 year sentence.    

    By the way. WTF?

    On probation fighting over a stupid stolen ipod.  Sure hope it was a 16gb touch.

  10. If it's determined he's in violation of his parole then he may be sent to prison to serve the rest of his sentence.  It is all up to the judge and his probation officer.
