I'm sure there's nothing that can be done....but he was employed through a temp service and the company kept pushing him to put in for full-time...he told them he had a criminal history, and they said, "let's go ahead and apply anyway. We don't make the decision, corporate does, but I'm sure you'll be fine, since we want you." Less than two weeks later, he was fired due to his background check. Is there ANYTHING he can do about this? I mean, I know they can fire him over it, but does he have any RIGHTS as far as this is concerned?

  1. Nope, sorry, nothing he can do - he has no rights in this situation.

  2. As long as the background check was correct, there is nothing he can do.

  3. Did he fill out an application form? Was he asked on that form "have you ever been convicted ...."? Did he answer that question honestly? If he did answer it honestly then I would question why they went ahead and ran a background check on him if that would be a problem for the company to hire him. If he did not answer the question, or did not answer the question honestly, then it is grounds for the company to not hire him. (Not answering the question does not get him out of trouble as it's considered fraud by ommission.) Did the temp service not tell the company this?

Sorry, but there is nothing legally he can do.

  4. unfortunately they have the right to fire you if you cross your eyes. It is called being a at will employer which means they do not have to have a reason to terminate you.

  5. Rights?...........he did something serious enough to get fired over and your asking for rights.......get a life.........he could be a pedophile and work as a kindergarten teacher.......he has no rights......
