My brother was driving a vehicle owned by me when he was involved in a hit and run with a pedestrian.?

He was impaired and refused to tell the police it was him driving. I got the summons and need to know what to do now?

  1. Did he try to run (as in HIT and RUN)?

    That would be a BIG problem.

    Now you have to explain the cops and DMV that it was your brother who was driving.  Don't think of it as betrayal or something.  It was he who (essentially) framed you.  He should come clean.

    Go see a lawyer and don't make this problem into a bigger problem

  2. I would strongly recommend reporting this to your insurance company. Your insurance company may provide you with a lawyer if need be.

Refer the complaint to your insurance company.  They will refer the matter over to defense counsel who will represent you and your brother if he is a named defendant.  The fees and expenses are an additional expense that your policy will cover.  Hopefully, your brother will cooperate.  As an FYI, if your brother has insurance of his own, he should notify his insurance.  His policy will kick in if your limits are exhausted.

    Edit - the latter would only apply if the summons you received was a lawsuit filed by the pedestrian.
