Question:

My business went under & they are holding an auction... do I have a right to be there?

I had a business for 9 years and had 10 employees... we tried but in the last year things went south and as hard as we tried and as much marketing we could do. We had good relationships with all our creditors except our banker. Well he was fine until we couldn't pay the bills.. and we called him months before letting him know things were getting very tough and wanted any guidance or advice. Anyhow, he said "well, there is a recession and things aren't going well for a lot of business's so if you have to go under you have to go under." No help, nothing. We did get some guidance from our local college but it wasn't enough to save us.

Anyhow, before filing bankruptcy this week, we let the bank come and get all our business possessions (they even took the USPS priority mail boxes) and they are auctioning it off tomorrow.

Can I legally be there? I want to videotape it because it is at our old office location and because they have not treated the products well, breaking things.

NOBODY CAN KEEP U AWAY!!!!  If I were u I would go to the banker (or whomever came after the usps equipment ) took that equipment ILLEGALLY.  If it were me I would call him and insist on a face to face meeting and tell him you have documented everything including the horrible actions of the auction company.  If the bank is not responsive to you then I would tell him you will press for a lawsuit.  Then just sit back and wait.  You never know what might result.  Since this is my idea let me know what takes place for I would be interested.  I do not want to stick my nose in but it's already there.


  2. Sure. Its a public event. THey can't prevent you from being there.

Is it a public auction?  Certainly you have the right to be there, or bid on the things being auctioned, but you will have to follow the rules they have set up for the general public.  Being the prior owner does not give you any rights.  They may not permit videotaping, for example.  If you see evidence that something has been mishandled or broken, what do you intend to do?  Can you prove it was unbroken when you left it for them?   It would probably been better to videotape he stuff before the bank collected it.
