Question:

My car got hit and i dont know who did it?

My cousin who has no drivers license borrowed my car for his driving test. After that he ended up taking my car when he went to work at the mall. After his shift was done he went to my car and found out someone had hit it but noone left a note. He didnt know what to do so hes just taking it to a body shop and paying for it out of pocket. He was going to call the police but he was afraid they would ask for his license and he has none. The damages werent too severe, he got an estimate and it looks like it would cost around $700 or so. Some scratches and a banged up door. I have insurance but its liability only. If i was to make a police report or call my insurance would there be any way they would pay or take care of it? I dont know what to do as my car has never been hit before

  1. If you only have liability insurance, they are not going to pay for the damage to your vehicle.  You need to have Collision coverage or Uninsured Property Damage Coverage.  

    You and your cousin should work out a resolution.


  2. You don't carry coverage for collisions....therefore, your insurance won't get involved anyway.

    Police won't usually come out & make a report if your on private property.

    You should be glad it wasn't the other way around.  If he had hit another vehicle & caused an injury you'd really have some problems then.

    Let him fix it and move on.  Next time someone wants to borrow your car, make sure they have a license!!

If you have only liability coverage, your insurance won't pay for this damage anyway so it would do little good to make a police report for that purpose only.  If your cousin can/will pay for the repairs, I would leave well enough alone.  It will save him a day in court and more out of pocket.

  4. Since you only have liability, there is no way that your insurance is going to pay.

    Since it was on private property I don't think the police will even come out and write a report on it.

  5. Most states have a cost limit when it comes to reporting accidents to the police.... In New York, if the damage is more then $400, then the police need to be called and an accident report filed... Since NONE of that was done and your cousin offered to pay for the damages,  Get the money UP FRONT and get the vehicle fixed.....BUT do NOT let your cousin drive your car again UNTIL HE GETS HIS DRIVER'S LICENSE.... YOU would be liable for ANY damages he might cause while driving YOUR car even though he would get a ticket for driving without a license...It's YOUR car---protect it... don't be so foolish as to let an unlicensed driver take it again... NO MATTER WHO THAT PERSON is... Wise up !!
