Question:

My car got scracthed really bad b/c of an illegal parked truck.?

so, i turn the corner.. the truck stop in the middle of street. i honked my horn he told me to pass.. i did on the right side. so my car got really badly scratched.. i called the cops, he got issue a ticket for illegal parking. is it my fault b/c passed by him.. or is the accident his fault b/c he parked illegal he cause the accident. now this was one of those huge trucks.. his covered more than 1/2 the street with his truck.

the question is, Is it my fault?

  1. Yes, it is your fault.

    You saw the truck parked illegally (for which, he got a ticket) taking up too much of the road.  But, it was your choice to pass him or not to pass him.


  2. If he was stopped and just sitting there, and you were the only car moving, the accident is automatically your fault.  You are responsible for making sure your car doesn't hit stuff.  Worse if you scuffed his trailer, you gotta pay!

    He's guilty of other stuff, yes.  But that doesn't work like a guilt magnet making him guilty of everything around.  If it did, then the guy in the upstairs office cheating on his wife would be guilty for all of it! LOL!

    Once I was on a Philadelphia streetcar, an instructor was training a new driver.  Some idiot was trying to squeeze down the half a lane between the streetcar and the parked cars.  The instructor said "When that happens, stop and don't move.  If the idiot clips the streetcar or a parked car, he'll sue us, and if we're not moving, he can't make a case against us."

  3. Well, why would you pass him knowing what you did know?

    Yes, it is your fault.  You CAN take some responsibility.

  4. He shouldn't have been issued a parking summons. They should have given him a summons for obstructing traffic, a moving violation.

    You passed him on the right which is legal only if he is stopped and waiting to make a left turn. Since you say he was parked, you committed a violation also and you should have also received a summons.

    You are both at fault.

    He should not have been there and you should not have passed him on the right.

  5. If I couldn't fit thru, I would have backed up and went another way.... your own fault...

  6. Let's just say, the person who mis-judged the size of his/her car, and drove through a space he/she couldn't fit through, is at fault for the damage.

    Nice try, though;  why take responsibility for your own decisions and actions, when you can find somebody else to blame?
