Question:

My car was hit by an uninsured driver?

it was parked by the shop where i work.when i finished work i went out to my car and a lady had put a note on my windscreen to say my car had been hit and to call at her house.i did and she gave me the reegistration number of the van that hit my car.she even spoke to the bloke driving the van and he said "the owners not here what does it matter"

anyhow we claimed on the insurance as the other viehcle isnt insured(so my insurance company say) we had to pay a £200 excess.how do we go about getting this money back?the police have the details of the van so can they give us the details of the driver so we can claim back our money from him.

do we need to see a solicitor?

  1. No you do not need a Solicitor. Sue him in the small claims court. Get a claim form from the clerks office at your nearest Court. It comes with a good explanatory booklet and the procedure is quite straight forward. You pay a small fee but this is added on top of any damages you are awarded. The police may not release the drivers name and address to you but if you write to the DVLA giving them the circumstances and the Registration Number they will.  (I had a similar occurance)


  2. as you got details from a third person(not involved)this is a fail to stop and provide details accident and the Police should be taking action against the offending driver,,,,,keep at them and threaten a police complaint if they dont,

    you can also claim thru your insurer (who charges you an excess)to contribute to insurance companies compensation  board(similar to the criminal compensation board if you are assaulted etc)and make sure they do not remove your no claims bonus as a result(they will try)

    sorry but you may have to pay the excess,,,,

    i did but it took 2 and a half years to get it back

  3. What did your insurance company say about it? Surely they would want to get their money somehow.
