Question:

My car was hit from behind?

The car was towed to a lot, the insurance company then took the car without my permission to another lot, upon my finding this out i demanded my car back. They have since towed my car to my house so i can get my personal belongings back... upon delivery of the car i noticed many things are missing!!!! what are my options? I have already notified the insurer

  1. firstly, the insurers usually get the car towed to the nearest holding yard at time of accident, this is to get it somewhere safe fast. then they will move it to the yards that they have deals with - same time of thing as they have with approved garages (they get discounts there). as for the personal belongings, as you have already logged it with the insurers, i would now go to the police station and log it with them, get them to take a statement which you can forward to your insurers (this shows them that you are prepared to take matters further and will usually assist you a little). submit a list to the insurers noting all that was taken, receipts if you have them are a must along with estimates for replacement items. bear in mind, most policies only have a limit of between £100 and £250 for personal effects in the vehicle. if you only have tpft cover, you will be better off contacting your house insurers to handle the claim for you and they can recover costs from the car insurers. i hope this helps you.

  3. Unless the first towing company made an inventory of what was in the vehicle prior to them towing it you are probably SOL as you would have to prove that the stuff was in the car.

  4. You can't prove anything was taken, so  you're screwed. This happened to me.

  5. Your only recourse is to file a police report. But don't if you had drugs stollen.

    I usually record the serial numbers of expensive items. you can turn the numbers over to the police and insurance co.   If the amount of theft is over $300, it is a feloney.  But don't expect the cops to do anything, they are pretty much worthless at this point.  Unless someone gets hurt, they don't give a **** about property damage unless it happens to them or one of their friends.  The only thing they will do, if the detective has half a brain, is to see if there are other theft claims againt this tow company.  This is why you must file a report.  If it doesn't help you, it will help to nail them then  the next brave and pisssed off person files a report.

    Since you were hit from behind the liability of damages is the person at fault.  The theft, if the police won't do anything, must be claimed againt your car policy.  If the items do not add up to the value of your deductible, it is not worth it.  Go see a doctor about a strained neck and settle for damages to your car and your

    "injuries".  This includes physical therapy.  Even if you don't need it, they will teach you how to keep a healthy back and neck.

    I dont condone illegal activity like putting suagr down the Tow Truck's fuel tank nor the employees cars.  Putting nails in the tires causes slow leaks but a puncuture in th sidewall is irrepairable, this is also illegal.  Remember, no more than an eye for an eye.

  7. You should first report this "theft" to the police dept. Then Your claim should be  with the towing company and their insurance company.  I would also report it  to your own insurance company.  (don't tell either place you made a claim to the other).  I doubt very much that you will have any luck though.  Good luck
