My car was rear ended 2 weeks ago(wasnt my fault)?

damage to my car is estimated at 800 and my laptop which was in my trunk was broken to, its worth 900(theyre gonna pay for its replacement). I had to go to urgentcare right after the wreck for back pain and additional pain to a hernia surgery i had a month and a half before the wreck(the seat belt caused massive preasure on the area resulting in lots of pain). Since then my doctor has sent me to physical therapy but my back is getting worse and pain to my groin area where i had my surgery has affected my sexual performance(very emotionaly damaging).

what kinda settlement is the insurance company gonna offer me? and by the way im in 18 year old male with no prior back injuries. i estimate final cost in medical bills to be between 2-4000

  1. If I were an adjuster (I'm not) and I heard this story, I would think that you are trying to put together a case for litigation.  

    I would wonder how so much bodily injury could occur when there is very little damage to your car.  A minor rear end accident would not likely cause your seat belt to put "massive pressure" on the area of your hernia surgery.  As your car was hit from behind, you would have been forced back against the seat, not forward into the seat belt.

    I would offer to cover your auto repair, laptop replacement and your medical bills with nothing for "emotional damage".


  2. they will pay for damage to your car and laptop, a rental car if needed until your is fixed, any loss of time from work due to the accident, and medical bills.   sorry, but they aren't gonna pay you because you are having emotional issues becasue of sexual performance or lack there of.  also, its going to be hard to prove that your "problem" is due to the accident and not a pre existing condition, especially since you just had surgery for just that...a pre exisitng condition.

  3. The insurance company is always going to try to offer you as little as possible.. but it's all negotiable.  

    I am not sure if you'll get damages for your sexual performance, but it's probably worth talking to a lawyer if you're intending to try to get more than just the acutal replacement and doctor costs.

  4. Don't immediately get an attourney.  More often than not, they just slow the process down.

    See what the Other insurance company is going to offer first.  Come back with a counter offer.

    If they ignore you, then you might need to get a lawyer.

    Have you spoken with your own insurance agent?  Part of your premium is so that they will go to bat for you against another insurance company.

    Talk to your own health insurance provider.  They're going to want to get their money back from the other insurance company too.

  5. Why did you not hire an attorney???  Don't sign nothing till he assesses the damage cause he is gona sue the other insurance company for $250,000 and he gets to keep half.  Don't handle this on your own -- your 18 and have no experience --- the attorney does...
