My car was repossed 3 years ago I never recvd anything from them after they took the car?

Today recvd a civil complaint from a collection agency who is seeking a judgement from the repo. Is this legal I have know idea who this collection agency is they have never sent me anything regarding the repo. I don't even know how much I owe! Doesn't the Collection company have to send me a bill?

  1. When your car gets repoed you still must pay the remaining balance that you owed.  This happened to my best friend.  They did not even contact her until over a year later.  She ignored their phone calls and they are still trying to get her but she refuses to pay.  It's been three years and now they are threatening to garnish her wages (which this is all legal).  So if you had any kind of debt on the car- it's legal.  I would set up a payment plan (tell them you can only afford "X" amount of dollars/ month).  This way you will not have negative marks against your credit.


  2. You need to check the laws on repos in your state, as many have specific guidelines that a creditor must follow in order to claim the deficency, and if they cannot prove in court that they followed these guidelines then you can easily beat this lawsuit.

    Such as in GA, the creditor must send within 10 days of the repo and by certified mail a letter advising the debtor of their rights to demand a public sale and/or their right to retrieve the vehicle. If the creditor cannot produce this document and proof it was sent certified mail, then they have lost their right to claim the deficency.

    You might try contacting a lawyer from NACA.net and see if they will help you with the laws in your state and file an answer to the lawsuit.

  3. Quite likely the dealer sold your remaining debt to a collection agency.

    After  the   repo ,   the  lender  sends  a  letter  letting  you  know  how  much  was  received  for the  vehicle  at  auction  and   how  much  you  still  owe  after  the  auction  credit  was  made .

    YOU   were  suppose  to  maintain  communications  but  if  you  didn't ,

    Then   they  turn  the  balance  due  over   to   the  collection  agency .

    Consider  the  civil  complaint  a   bill ,   because  the  court  will .
