My car was scrathced and dinged badly at Park n Go in Atlanta by the Valet service. How do I get them to pay?

I parked my car at the Valet service of Park n Go in Atlanta and when I got my car back I noticed a few dings and scratched glass. Now they are denying my claim. Here is the problem: I got back to my car after 10 PM. It was dark. 15 minutes later when I was at the gas station I saw the damage since it was bright there. The insurance company at Park N GO are claiming that since I did not make the claim at the time I left the parking lot then I have no claim. Anyone have experience with this? Has anyone fought a parking lot and won?

  1. Just show them proof that the scratches were not there when you parked the car and were there when you picked it up.  Simple as that.  I'm pretty sure there is no way for you to do that so there is no way you can convince a court that they did it.  Especially if they say they didn't.  Lesson learned, always check your car after someone else touches it.


  2. Since you didn't notice or report the damage until after you'd taken the car off the lot, they have plausible deniability that the damage ever happened on their lot.  You've got a tough, uphill road if you want to fight them.

  3. You can file a claim with your insurance and let them "attempt" to subrogate against them for reimbursement.
