My car was stolen and involved in an accident in another state. The Other driver is uninsured and is suing me for damages.Can he if this was out of my control? My insurance will not pay because the vehicle was in a state of theft therefore they werent responsible for damages.

  1. I saw a situation similar to this in which the judge stated that the this was beyond the control of the driver.

    The most important part is that the vehicle was reported stolen as soon as possible. You need to obtain a copy of that police report...a lawyer would be wise as well.


  2. The other driver has no case against you. The only way you could be tied to damages being inflicted on them is if you were responsible for your car having been stolen.

    Besides, it is illegal to drive without insurance, so that driver broke the law by not being insured.

  3. No, you are not responsible if you filed a police report.  They need to sue the person who was driving the car, not you.  Your insurance company denied their claim, and you should do the same thing.

  5. 1. Call your insurance company and tell them about the lawsuit. They should defend you. Do this ASAP. Even though they won't pay the other guy they probably still owe you a defense.

    2. The guy suing you has no legal basis to sue you as long as the car was in fact stolen and that can be documented. He is just an uninformed idiot.

    3. Any competent judge will toss the case out once documentation is shown that proves the car was stolen. You are not liable just because you own the car.

    Get on this fast because if you wait too long, the other guy wins by default and you won't get a chance to prove your case.
