Report it to your insurance company.  They will do the work.  They have to...  If the car repair company does not pay they will have to.  The insurance company may pay you out anyway and pursue the repair company.

They absolutely are liable. I own a body shop and we are responsible for the care and safe keeping of our customers cars while they are in our care. Legally they are to have insurance to cover their butts in case something like this happens.
