My case has been assigned to the court. but i received a letter stating that all cases are set for dismissal

six months from the filing date. My case is set to be dismissed on 12/04/08. It also goes on and says this is not a final trial date but rather a deadline to finalize your case. what does that mean?

  1. Given the number of cases that are filed each year, a lot of courts now have backlogs of cases.  One way that courts try to deal with this backlog is by having automatic dismissal rules.

    Without knowing what court we are dealing with, I can't give you the exact rule for your court, but, in most jurisdictions, if you let a case sit without any activity for more than six months (i.e. no. discovery requests, no notices of deposition, no motion for summary judgment, no trial setting), you will be required to appear in court at the dismissal docket and explain why your case shouldn't be dismissed.

    The bottom line is that you and your lawyer need to be working on getting your case ready for trial.  If you don't, there won't be a case to take to trial.

  3. This is for Tmess, have to answer a petition and have no time nor money. Do I need to answer each question posed by the plaintiff's lawyer and can I just answer as false, false etc., need to buy time to hire a lawyer
