Question:

My case/report got fowarded to the state sttorney?

update...called the state attorney. because my case/report had been fowarded to them. so I called and i was told that it would take 5 to 6 weeks to know if the procecutor will fille chages against me and that it need to be reviewed. I live in florida. i need some advise to what will happen....i am so worried and scarerd for my family, like what i said never got into trouble with the law. and why does it take so long to get an answer, was it because i was not arrested, because that what i was told..i am so confuse. if u would like to know more details to what had happened. please check from my profile (ask questions) any adive would help, thanks in advance.

  1. Hello Carol. I know it can be very confusing and frightening to be on the receiving end of criminal charges but I will try to explain some of the process here.

    When a prosecutor receives a report, he is going to evaluate it for criminal actions and intent. A District Attorney, among other considerations, is also charged with being responsible for expending public funds ( which is what is used to prosecute any case ).

    Deciding on prosecution is often not so much a matter of whether a person is guilty but of whether they can win the case in a court of law. Obvious loopholes are explored and determinations are made (in percentages) as to whether the case will return a guilty verdict.

    You might consider this like a hand in poker.If the DA has a strong hand, he is going to go for an indictment and prosecution. If he feels the hand is weak, he is going to fold, throw in the cards and drop the case.

    The reason it may take up to two months is due to the quantity of cases that go through his office on a daily basis. ADA's will go over these first and it will go up the chain of command until a decision is made either way.

    I know this doesnt help the anxiety levels at all and without having any idea of what else is involved in the particulars here, this broad outline of the legal process is the best I can offer.

    Be patient. If you do not hear from the DA's office in 6 weeks, contact them for an update.
