My dad died 2 weeks before he received stimulus check. Can I deposit it in our joint account?

My father did not leave a will. We have a joint checking account, and I am taking care of all his affairs.

  1. If you have been appointed as a personal representative for your dad's estate through the court, you could file a form 1310 (Statement of Person Claiming Refund Due to a Deceased Taxpayer) and have the IRS issue it in your name to deposit.  (Well it's easiest if you're an appointed personal representative.  You can still do it if you're not, but it's a longer process)

  2. Probably not.  Return the check and a form 1310 to the IRS and they will issue you a new one.

  5. yes, i would think so you have a joint account and you would deposit it any other day, and besides if you don't the gov. will just take it back anyway.

  6. From the date and time of his death, all checks written or received, after this time are null and void.  If the check was written or received before his death, I believe you can deposit it.

    Before you do, I would check with the bank.

    If in doubt, you can get a visit with a local lawyer for $15 by calling your state bar association and having them recommend one.  It's only a 15 minute visit, but it's better than having to fight it in court later if you are wrong.
