K so my dad bought a car from one of those discount car lots back in 05. there is a lien on the title in the dealers name, but now that my dad is selling the car is it required to have the dealers signature since there was a lein? Also that dealership is no longer in business and he has moved to NC (we live in SC). So will they let my b/f get the car in his name or not? Or how should we go about getting the car in his name? Any help would be appreciated, thanks!

  1. The loan has to be paid in full.  when it's paid for, they sign it and send you the title.  Your boyfriend has to have a valid title to get tags, so you'll need to go through that step.

Your dad already knows all about this, though.

  2. Your father needs to contact the dealer that has the lien on the vehicle. He needs to request the title or a notarized lien satisfied from the dealer. If the lien is paid off, this should not be a problem and the dealer should accommodate him.

Only after that is accomplished can the sale be made to your bf.

  3. if dad is financing have to get approved by the bank or you bf can get his own finance company or bank to back him and take over the payments...if not financed from bank or anything he can just take over payments until payed off and then when completely paid off your dad can transfer title to your bf...this is if you and your dad have a lot of trust...i mean alot

  4. Who is your dad making payments to on the current lien?  That is the signature you will need to release the lien on the car.

Your boyfriend cannot get it in his name until the lien is released or unless the lienholder agrees to it.
