  1. Yes through the courts. You can also hyphenate his last name onto yours, making your daughter's name "Smith-Jones" for example.


  2. Of course it can be.

    Depending on how old she is, and in which state you live, it might require a lawyer, and a small amount of money (lawyers' and filing fees)

    You cannot just change it -- you have to go through the proper channels to have it done legally, and it's not just the birth certificate.  You also have to have the change made on her social security number card, etc.
