  1. You need her birth father's written consent, or else he has to forfeit his parental rights to have this done. I'd suggest you contact the Family Law internship center at Ohio State School of Law and get their help. Done wrong, you have a legal mess that can get really expensive to fix. Done right, OSU helps you and it doesn't cost you anything.

I live in Ohio.  I am changing my sons name this week.  Go down to probate court and ask for the name change form.  If someone is going to protest this, it can get messy.  In my case I have nothing to worry about.  Fill out the form, who you are, who she is, prior name, and what you want it to change to.  Turn it in, and pay 111.00, and it takes about 5 weeks to change.  I am taking mine in tuesday, so if you need any more help feel free to contact me.  If you have a good reason, it goes smoothly.  Good Luck!  Make sure if your daughter is old enough, and this is what she wants.  If she is real young, she will not be affected.  Kids want that feeling of belonging.

Actually, in California, you can use any name you want for your child, it's just not legally changed.  My grandson was not adopted by his stepfather until he was 8 years old, but he was registered for school with his stepfather's last name.  The school allowed it because of the family situation and it was the name the child always knew.  My daughter's first husband didn't care because he "thought" it got him out of child support ~ surprise!  it didn't.
