Question:

My daughter was burned by a carnival ride operator. Should we press this issue or forget about it?

My daughter is 3 and was being taken to a carnival ride by her father, who was holding her hand. As they walked past the ride operator (who had his back to them), he lowered his hand with a cigarette in it and burned my little girl on her arm. He brushed her arm a bit to wipe off the black ash and tossed his cigarette to the ground. He did apologize, but a small burn mark appeared, the size of the end of a cigarette. It was an accident, but he wasn't supposed to be smoking and now she has this burn blister that will probably leave a small scar on her lower upper arm. We went to the General Manager where he told us that ride operators are told not to smoke and that he would be dismissed. We gave our info to the police as well as the manager. He refunded her ride tickets and gave her and my other child a free stuffed toy. We then went to the first aide building to have something put on it, which they did. We happened to walk back through a couple of hours later and are pretty sure we saw the same ride operator working a different ride for older kids. Should we push this issue any further by speaking to a lawyer or drop it?

  1. I would have personally beat the **** out of him if it had of been my daughter. It would have been an initial reaction.  Based on your situation it sounds like it generally was an accident..but you have a right to be pissed.  I would have torn him to pieces before he had a chance to apologize..but since you didn't obviously he had a chance to apologize and he did go out of his way to show that he was sorry.  You "Could" do a lot at this point if your really pissed about it (and I would be)..but from another standpoint..he shouldn't have been smoking.  Calling a lawyer though would do something but it won't really do anything to make up for what happened.  It would make you feel better but aside from that...perhaps criminal charges.  BUt I doubt that'll hold up.  A lawsuit definitely would..it just depends on if you think it was worth it. It would go ahead and talk to a lawyer and see what can be done and decide based on what the lawyer said.


  2. Ask yourself this - if it had been another carnival patron instead of an employee, would the idea of a lawsuit even come up? It was an accident - they happen.

  3. I would have smacked the c**p out of that guy! Get that ****** dude fired! Your daughter should NOT have gotten burned from a cigatette because the dumbass doesnt want to be careful & shouldnt be smoking in the first place! Good Luck! :)

  4. Just drop it. You got a refund and free things he probably got written up and assigned to a different area. As long as your child is not suffering then leave it be a lawyer would not do any thing any way. Just don't go there any more if it makes you that upset.

  5. With the way our society has become with everyone suing someone for something. I am very surprised you haven't called a lawyer already. I however am so against people suing over every little thing. Your daughter will be fine and he apologized. Yes he shouldn't have been smoking. My mother who died from smoking shouldn't have been smoking after she found out she had lung cancer but she still couldn't quit. It is very addicting and he made a mistake. Just let it be. Please don't add to the number of ******* trying to get something for nothing by suing......

  6. i say you dont sue, but i would have been absolutely PISSED.

    if it leaves a serious burn than get fussy but if it is going away i would drop the issue
