My daughter was raped by 3 guys and they are getting away with it...what can I do?

My daughter was raped on June 7, 2008 by three guys. Two of them are 19 and one is 16. They drugged her and served her alcohol. She had physical bruising and the SANE nurse at the ER said she had forced abraisions in her mouth and in her genital area. We are pressing charges against all three. But found out today that the county atty is dropping the charges on one of them because it was their word against hers. That is BS...she is 16 and they are adults. She was drunk and was not in your right mind. She remembers what happened and she said she DID not consent to this. I think the police in my town are scared of the black community and therefore are not going through with this. Two of these boys are from Chicago and have been in trouble there before and the other from here is no stranger to the police system. What do i do now. My daughters life has been ripped from her. I as a mother have to sit here and think of the nasty disgusting things they did to my little girl.

While I am deeply sorry for her as a father, lets look at your statement.

They served her alcohol you say.

Served is not forced upon her.

That may be the sticking issue her.

They may be thinking she just got in over her head and then cried rape to cover herself.

Abrasions can show rough, but forced?

Was she a virgin or can others be called she had s*x before? Can others be called that she likes to party and drink?

By being served, she got herself drunk and her recall may not be clear.

These are easy questions, but a sample what a lawyer would bring up to defend the guys.

I am sure your county attorney would not have dropped this if the case was not weak.

Ask to meet with them and ask to see why.

Make very sure she is not lying to cover her butt or 4 lives will be ruined.

Please do not take this the wrong way, I feel for you and her as a father of now grown daughters, granddaughters.

If you find the facts are true, call TV stations and tell the county attorney of your plan. Contact your state attorney and bring heat down upon them.

But, make very sure you have all the facts and a true story or this will be even worse for her.

Maybe there is more to the story?  Are you 110% sure she was drugged?  If she just went and had a drunken orgy, I have no sympathy.  Too many girls go out, get drunk, have s*x and scream rape.

Call the press. If the local cops aren't willing to touch it, maybe someone else will. Call your local newspaper and tell them your story.

Document everything starting right now.  Make copies of all doctor's statements, and get written statements from all possible witnesses or accomplices that you can.  Hire your daughter an attorney - contact victim assistance in your area.  Most importantly, get your daughter in with a good therapist right away.  Don't stop fighting this.  Go to the media, the state attorney, whoever will listen.

The Police have investigated the crime from top to bottom and discovered the girl was all for the party. Police stated there  was no crime and prosecutor agrees with this. If more evidence shows up then it is possible charges may be brought up.

Consult with a Lawyer. If the Police wont take these matters seriously, take them to court; Thats the only advice I can give you.

Take your daughter to therapy to lessen the psychological trauma. If you wait too long, she might be permanently damaged.. Next time.. watch over your daughter more carefully. You have to tell her gently to stop hanging out with the wrong crowd. Nothing good can come out of it. Better be alone than ruin your life with drugs, s*x and alchohol.

If by drugs, you mean one of the "date rape" drugs, they're difficult or impossible to detect a few hours later. There's no reason to think the police didn't work it. You just said the prosecutor, who is not the police, dropped it. It comes down to whether or not there's a case with a chance of successful prosecution. Without firm evidence of her being covertly drugged, it comes down to drinking, drug use, and s*x. The prosecutor has to prove force was used without her consent. Even with the age difference, the question is consent. Juries do not convict 19 year olds for consentual s*x with 16 year olds. You can talk to the prosecutor about the case, but he's got to put his resources where they have a chance of accomlishing something. You can also talk to the rape crisis center staff. Sometimes they have influence. You should already know them. If not, you need to. Hard lesson learned. If it won't be prosecuted, you do your daughter no service by harping on it where she can hear. Work on recovery.
