Question:

My daughter was terminated from Hooter's. No reason given. Can they do this?

She was in her probationary period. No evaluation, no "gee, you need to do this to improve?"

  1. Hooter's has it's applicants sign a paper saying that their employment is "At-will" employment. "At-Will" employment basically means that even though they work there and do a great job they can still be let go from the company without a reason.  I googled a copy of a application and found this.

    "All employees of Hooters are “at will” employees. Accordingly, either the employee or Hooters may terminate the employment relationship with-out notice at any time for any reason, or for no reason at all, except as prohibited by applicable law. No act, policy, procedure or practice of

    Hooters may modify this “at will” employment relationship. The “at will” employment relationship may be modified only by a written agreementbetween the employee and Hooters which specifically modifies the “at will” employment relationship and is signed by the employee and the

    President of Hooters. I understand that nothing contained in this employment application or in the granting of an interview is intended to create an employment contract between myself and Hooters for neither is binding upon Hooters unless made in writing.4.I understand that I may be required to take one or more physical exams, blood tests and/or drug screening test(s) as a condition of hiring or con-tinued employment. I agree to consent to take test(s) at such time as designated by the Company and to release the Company, its directors, offi-cers, agents or employees from any claim arising with the use of such tests".

    I don't know what state you are( in I'm in California ) but I'm sure Hooter's might use the same application and go by the same rules, but I posted a copy of the application on the source list so you can read it. Another suggestion would be to have a unfamiliar girlfriend walk into the Hooters like she's going to apply to get an actual application from the store your daughter was terminated from and bring it to you so you can see what is on there about "At-Will employment". I'm sorry about what happened to your daughter...you're a good mom for looking out for her.
