Question:

My dog supposilly bit someone within a feet outside our fence; is that person trespassing?

I heard of the 1-foot property line. My german shepherd cannot stick it's snout any more than 5 inches. So technically, isn't the man trespassing?

  3. If your dog was outside your fence and there is a leash law in your municipality (town) – you are responsible. Period.

    If you were abiding by the leash law and someone came up to you and got bitten by your dog – the dog could have seen that person as a threat and done what a dog is supposed to do – protect you – so who would be responsible is questionable.

    Edit: I wrote that before I read the entire question. Your dog was inside your fence? If so, you have nothing to worry about. There is no logical reason for someone to walk THAT close to your fence unless their intent was to provoke your dog. Don’t worry. The person who got bit deserved it.

    Dogs are territorial and if the person extended their hand or reached over, through or touched the fence – they would provoke a dog’s instinct to protect you and your property. What a jerk.

  4. idk about laws and stuff, but the idiot was probably sticking his hand inside you're fence. is he suing you or something? if he is, then good luck, I hope you don't have to pay him anything =]

  5. I would check your local law concerning the one foot rule.

    Where I live  dogs have to be leashed if not on their property.  You might check in to that in your jurisdiction, too.

  6. As long as your dog was still inside the fence when the alleged bite happened then yes I think it probably would be classed as trespassing.  The person should have known better than to get too close to the dog's territory.  That person got what he deserved.

  7. He has to prove that he was outside your land and if he did try and take it further and didn't have proof (cctv etc ) then you could quite rightly counter claim for trespass
