My dog was attacked.?

a so called friend of mine's dog attacked my dog and has damaged his eye had emergency vets cost me a fortune, but is she liable to pay for the damage her dog has caused?

I think it would depend on all the circumstances as whether she is LEGALLY obliged to pay the vets fees.  It would depend whether it was in a public place; was her dog under her control; was yours under your control?  But I do think that MORALLY she is obligated to pay no matter where it occured; or at least contribute to the cost depending on the the circumstances .


  2. well..was her dog on a leach at the time? was your dog on a leach at the time.....is it not laww that they should be restrained? was you dog on your own property at the time? if so...then your 'friend' is liable to pay......assuming that ..like i say....your dog was on her own property, and this other dog came in.....un restrained and then attacked.........

    so yes......the 'freind' would be liable...if that was the case........

    which ever dog was unrestrained.......is the liable one (hope that helps)

  3. Her pet insurance might cover it if she has it. She should check her policy.

    If my dog did that to a friends' I would offer to pay depending on the situation. Whose fault was it? Random attack or was your dog antagonising hers?

  5. sorry.. i have to say she should pay for the damage but also the dog needs to be put down.. a dog that attacks can do it again.. to a child anyone sorry to say it but if you reported it then it would have to be put to sleep.

  6. like others have already said, whether she's liable depends on the circumstances. if she is a good friend that you don't want to lose, maybe you two can split the costs.

Frankly, any sort of friend would, morally at least, surely offer to at least make a donation towards the cost of the treatment to your dog.  But without knowing the circumstances of this 'attack' I'd not want to comment as to whether legally you are entitled to make a claim on her.  I suppose it all boils down to how much of a 'friend' she is, and how much of a threat to others her dog is too!!

    Also where did it happen ? did you go over to her place and leave them in the back yard ? or was it while walking them ?

    have the played together before ?


  9. how exatly did it happen?

    where where the dogs? which dog aproched which dog first? were they both lose or was one or both on the lead? was it play that got out of hand? what were you two doing at the time?

    all of this will determin who is responsible, as just because jour dog got hurt doesnt mean it didnt start the fight. im nat saying it did but you will need to give more info and prove that your  friend is libal.

    But if it was me i would offer to pay a persent up to half. but everyones diffrent.

  10. It depends on the situation. If both dogs were off their leads then its unlikely. You trusted her to an extent where its not their fault. If their dog was off the lead and yours wasn't, then there is a good chance they're liable. If no dogs were off the lead then your friend wouldn't be liable probably. However, this is all assuming, its not rock solid.

  12. Hang on a minute.., if she is your friend isit her fault that her dogattacked yours? Why would you do that to your friend? But then again if she was a friend she would offer to pay the fee's. But still you shouldnt expect your friend to pay them. Its not really her fault her dog attacked yours. I think she could be liable to pay though. Get advise from your local solicitors.

  13. Depends if her dog was on a leed or not. If her dog is "potentially dangerous" to other dogs then it should have been on a leed and if it wasn't then, yes, she is liable to pay for the damage her dog caused.
