Question:

My employer forged my signature on a document...?

Recently I got hurt at work and on several of the workman's comp papers my assistant manager forged my signature on them and sent them in to the corporate office as well as the workman's comp people. I am not happy about this and I wonder legally what can be done about this? Would the company be held responsible or just the individual that forged my signature? I have proof on my answering machine where she says she forged it, and the company is harassing me because I got injured at work. Each day I go in to work, I get derogatory comments, evil looks and threats of losing my job. Legally, where do I stand, can anyone help me? Any feedback would be greatly appreciated. Thank you.

  1. Legally, you have very good footing.  I would suggesting discussing the situation with the local Department of Labor and possibly a lawyer.  The person who forged the signatures should be terminated from the position and the employer should be in some trouble for threatening to fire you for getting hurt on the job.  Labor law protects work-injury cases very strongly.

You might start by speaking with the top management about the situation, however, before taking the situation legal.

  2. you need to speak with an attorney.  This is the only way to resolve this situation with the company and the forged documents.

As far as the way you are treated at work, that is something you will have to deal with.  Many people feel that a person on work comp is faking it so they don't have to work or have reduced work.  They won't admit it, but they do.  This is more true if your injury is something they can't see.

An attorney with experience in work comp will be able to assist you more than anyone else.

  3. Be prepared to lose your job.

Sounds like you work for an ***.

    Forging is against the law.

    Contact Workman's comp.

I would ask the manager what is the problem.

When my people get hurt, I take them to the ER myself.

I have even paid on the spot for emergency care at the ER or an Urgent care clinic.

My best advice, find a new job.

    Then report her.
