HAD BROKEN APPROXIMATELY TWO WEEKS BEFORE IT COLLAPSED AND CAUSED MY INJURIES! I HAD BEEN SUFFERING FROM ZIADICA NERVE DAMAGE! NOW I HAVE MORE DAMAGE TO MY LOWER BACK WHICH IS NOW BROKEN! HOW DO I GO ABOUT FILEING A CLAIM AGAINST MY EMPLOYER WHO ALSO IS AN ATTORNEY?

  2. You can't sue your employer - you can only file a workers compensation claim.

    That's the deal with workers comp - in exchange for no-fault benefits, the employers are immune to lawsuits if you get hurt on the job.

This is a workers' compensation claim.  I don't know what state you're in but workers' compensation is likely the sole remedy for employee injuries.  Just tell your employer that you want to turn in a workers' compensation claim.  If he objects then you could report him to the workers' compensation rating bureau in your state.  Also, you should tell your doctor that this is a work related injury and they will pursue the workers' compensation claim.

  4. I would go to another attorney.  And see about filing a Workman's comp claim.  They will make your boss pay you for every day that you are out of work.  I wouldn't go to your boss.  He will try to find some way to keep from paying.  I wouldn't go to and attorney that your boss associates with either.  Get the phone book out.  There is probably a couple of workman comp attorneys in your town.
