My employer is holding back my money!?

I don't wanna disclose much, but when I joined in Feb, I was told (with gross modifications to my Appt letter over the offer letter) that I have some monthly components & some quarterly & half-yearly components.

I had already quit my earlier job, & had no choice but to accept. These deferred components make up 35%.

3 quarters are over, & my money is not released. I have requested my boss several times & he comes up with funny theories. Equivalent to my 1.5 months salary is stuck. I'm very unhappy & feel cheated. If u r in India, u know how nothing is illegal for an employer :(

Can anyone suggest a tacit way of dealing with my employer, at least temporarily, & to get my payment released?

    Though you have not given details, It is very easy to conclude where the problem lays.

    You got a particular package along with the offer letter. Based on the package you left the earlier job and joined this Company. But when actual appointment letter is given to you, you found the package is about 35% less than what it was mentioned in earlier given offer letter. I am right.

    For all practical purpose, the accounts department will refer only the package given in the appointment letter, which you have signed and given your approval, copy of which they received from HR department. Hence all payment calculations will be done according to the package given in appointment letter. Which is the final and legally holds good.

    Please note, you have not been cheated by the Company. The fault is with you, by not bringing the difference to their notice, before signing the appointment contract.

    Any how, if you have a copy of the offer letter with you, then take the both and meet the head of HR. He may able to rectify the mistake. You can bring this matter to the notice of Accounts head.  There is no point in arguing with your departmental head or Boss.

    You are lucky, if they consider your case. If they refuse to accept, then you cant do any thing. But they are right legally, they have not held up your arrears.
