My ex's income tax and rebate withheld for back support?

He is NOT married, and filed 2007 taxes and claimed they took both his income tax and stimulus checks. He also claimed that he had his taxes done in February and they took that and sent it in for back support. How come I haven't gotten it yet? Has anyone else received their back support from an intercepted income tax or stimulus check?

  1. yes. it takes about six weeks.both refund and stimulus check


  2. The problem is that if FMS doesn't know his filing status they have to sit on the capture for 6 months to allow time for a current spouse to file an Injured Spouse claim.  Unfortunately the IRS cannot share that piece of information with FMS due to confidentiality laws.  

    If he certifies his filing status as Single with FMS, they will release it pretty quickly to the Child Support Enforcement Agency and they will have to get it to you.  You'll have to ask the CSEA what their processing times are.

  4. Do you know this for a fact ? Or could he be telling you a lie ? Call your legal support person.
