Question:

My ex employer is witholding my last 2 wage payments as he thinks I owe him monies for a course he put me on.

I have my last 2 wage slips, yet he has not paid the wages into my bank account. I did not sign anything to the effect that on leaving the company I should repay the cost of the course to him. He is also witholding my P45. What should I do as we are not on speaking terms.

  1. Unless it was in your contract that he had the right to reclaim training expenses... he has no right to do so.  He also has no right to hold on to your P45.  Go to Citizens Advice to get assistance.

  3. Does he have a superior. If so you need to make an official complaint. I don't know what kind of company you worker for, but generally you need to be writing to a director. You should also contact the Citizens Advice Buero who will look into the matter for you. You may need to make the company aware that you intend to 'go legal' with the issue.

    As for your P45, make the tax office aware of the situation. You can easily remedy this by filling in a P46. I find it bizarre that a company would expect you to pay for your own training, but they canot make you do so unless you have signed a document agreeing to this.

Straight to your local citizens advice,but be very quick ,you only have a set time period to register your complaint,they will send you to the local social security office which issues the claim forms and instruction booklets,you will have no problems once you have done this as an arbiter will be appointed to deal with it as a go between,these cases are almost always settled out of court.Your boss is just trying it on.GO FOR THE THROAT,BUT BE QUICK.GOOD LUCK.It is illegal to withhold money due unless they gave you prior notice in writing.

  5. Contact your local Better Business Bureau.  Tell your former employer that he will be contacted by the BBB regarding the situation.  

  6. you should write to them/him and put your questions to them/ him giveing them 7days to answer if they have not answered you can then go see a solicitor or if you can not afford one contact ACAS either online or by free phone they will tell you what to do next or intervene on your behalf, in any event they can not with hold your P45 when you det your next job tell them that your old employer would not give you one(P45) hope this helps you really should join a trade union they have free legals for just this occasions.  

  7. First of all, CAB are useless. Big fellas and baseball bats is what you need. Get some BIG blokes you know to go round and threaten him. This is the only way to get snivelling b.astards like your ex boss to play the game.

    He needs a good scaring. It will do the trick no bother.

  8. he can not withold your money, nor your p.45...he has to pay you & then recoup the money he says he owes...he just can't tamper with your wages.  go to the citizens advice...they will help you....& if he doesn't cough up....speak to a solicitor on a fixed fee half hour!!
