Question:

My ex- has been paying child support and just got laid off!?

The child support was coming directly out of his check weekly...Is there anything I can do to get child support? My son is 16 and he has only been paying for the last couple of months!

  1. YOU CAN TAKE HIM BACK TO COURT..;. BUT MOST LIKELY BECAUSE HE WAS LAID OFF AND HAS NO INCOME OR VERY LITTLE INCOME, THE JUDGE MOST LIKELY WILL CUT YOUR CHILD SUPPORT DOWN, UNTIL HE CAN GET ANOTHER JOB.


  2. He can't pay support until he finds another job. Where do you think the support will come from until he is working again?

  3. The only thing you can do is wait for him to get a job - or get his job back..... If you report him and he ends up in jail - you'll make things worse. Besides, all that money accumulates and no matter how old your child becomes, once he owes you back pay - he owes you until the balance is o (zero)

Ha ha, I've been going through this for 15 years!  Eventually he will get another job, but it will be a few weeks before the child support collection agency catches up with him.  Then he will move on to another job and the whole process will start again.  Unfortunately, there's not a lot you can do unless he has accounts you can tap, but that will take time out of your schedule to handle that in the courts.  My advice is the live your life in a manner you can afford without child support, so that when you do get it it's just bonus money you can put away for college or something else for your son.

    P.S.  Whatever you do, do not accept cash from him.  Once there is a court order, all monies must go through Child Support.  You could risk losing your entire case against him.

  5. You will have to start all over again when he gets a new job. By law he still has to make the payments so if he applies for unemployment, you get yours but you have to be on top of things for that to work. The state does not automatically do this for you.

    Most likely you are in the dumper yet again. Dead beat dads are a dime a dozen and to hear them tell it they are wonderful dads, they just don't believe money is an issue.  Sure.

  6. When he starts working again he will have to pay again as well as any arrears, contact your lawyer.  

  7. Child Support does not stop due to work conditions. It will be delayed but placed in arrears. Not much you can do if he has no money coming in. If he files unemployment, they will notify the Employment office. He will also be required to note it on his application to draw benefits. getting your money will not be a speedy process.
