Question:

My ex is on parole. While on parole he was arrested and for that arrest he was given probation. Is that right?

He's on parole until May 09 for theft. He got out last Sept. and in May got caugt driving on a suspended license, fled from the cops and then stole a lawn mower to get away. They gave him a strict probation for stealing the lawn mower but aren't revoking his parole. This just doesn't sound right. I want to make sure that this is actually possilbe or what do I do to make sure that he is actually paying his debt to society. We had 3 kids and I want to make sure that they grow up with the opposite attitude towards the rules that my ex has.

  1. I guess it depends on his original crime, how much of his original sentence he spent in jail, and why he was arrested the second time. All these are factors in how a judge is going to rule on a case.

    Each case is different and you can't just bunch everybody together and throw them all in one cage. As much as we would like to.

Is this in the US????  Not sure what the limitations are but if he was on parole for theft related crimes and commits another one, then I am not sure that they can dummy it down to a misdemeanor and give him probation like that.  I guess a judge can do whatever they wish though....  Kind of like saying you are in time out concurrently for two different issues.

  7. He should have been sent back to jail for breaking his parole.  Most are.
