My ex let her boyfriend claim my kids on his taxes while we were still married. I supported them,is this legal

I receintly became aware that my ex let her boyfriend claim my kids on his taxes, I was deployed over seas and thought she was workin and agreeed to let her claim the kids. I supported my kids the whole year and she let someone else claim them without my permission, is this legal and what can I do???

  1. No, it isn't legal - he can't claim them even if you and she DID both give him permission.  If they live with her, you can't either unless she agrees, but she can't just let her boyfriend claim them.  You can report this to the IRS.


  2. CAll the IRS . then if you have to speak to an attorney ... sounds illegal to me.  and very sleazy.

  3. No, it's not legal. You can fill out Form 3949A, obtainable at the IRS web site, to report the fraud.

  4. They broke the law. Call the IRS and report the situation. She, not he, can claim them.
