my ex partner left me 6 months pregnant and is not interested in our son. he has left me with the mortgage, bills etc. to pay on my own and does not contribute a penny to our son. everyone says file for csa against him but he is self employed and is operating a personal account as a business account and as far as i know does not declare any cash jobs but earns alot of money. can he get away with this?? will this be like getting blood out of a stone or is there anything i can do for maintenance payments. could i take him to court or cant you go down that road anymore??

  1. Even people who are unemployed and on disability have to pay child support.  He is obviously making money and an attorney can help you with finding out how much.  He is legally responsible to help with the support of his child.  Contact an attorney or the Attorney General in your area.

  2. Talk to an advocate about the situation.  This scenario is not new to the courts - if he is using a bank/credit union account to make his deposits and withdrawals, then the court may require he produce his financial records. Is his name on the mortgage with yours?  If so, then you need to make some decisions. If his name is on the deed that could be trouble now or later. If he does not want to come to an agreement on his own, then go to court and get a claim against his future earnings.  Dead beat Dads can lose state licenses and have their tax returns and accounts levied.  Good luck to you.

  3. go to court if you have to - they will determine some kind of payment and you can request a modification hearing every 3 yrs (in PA) also, so you aren't stuck with the first figure they come up  with forever - he must keep the money somewhere make sure they check his bank records AND report him to the IRS as a tax dodger - maybe you'll get a reward

  4. Well I can't say what your ex is on here without it being stared out - but it's a two word phrase with the initials F B.

Yes you can claim child support off him. If he is refusing to pay then court may be your only option. Best thing to do would to be to talk to the citizens advice burro or contact the CSA directly. The CSA are slow however so it may take a while but in some cases child support has been backdated.

(if he is not declaring cash jobs etc then he is also guilty of tax evasion as well)
