My ex-wife got pregnant while we were still married. We both agree she's not mine.?

Our divorce decree says I have to release the child. I don't know what this means. I said she wasn't mine, and so does my ex.

  1. you can have a paternity test done to find out if it is yours or not. If you don't care, you can sign away all rights to her.

  4. It's just a formality to have it in the paperwork in case one day you tried to go pick up the child or tried to sue for custody. .that way it's already in the papers that you have no rights to her..  not saying you would, but legally, they are just covering the bases.

  5. First of all....his wife is NOT a w***e! They weren't together anymore! MEN STOP AND THINK!!!!!!  When the mood hits YOU  what would you do if you "got" pregnant!?!  MAYBE she used protection and it failed!!!!

           Ok, on to your question....  If you have both agreed that the baby is not yours in court then by releasing the baby it means legally you wont have any rights to the baby. You wont have to pay child support, no insurance,nothing. You will have no responsibility to the baby. When she delivers if she still (your wife) still has your last name,they may use that name on the baby's birth cert. but that still doesn't list you or include you as the father because you have released the child and you would not be listed or named on the birth records as the father. It would also mean if anything ever happened to your wife you would have no legal claim or rights to the baby. This isn't like you are giving the child up for adoption. You are simply saying the child is not yours. If the situation changed and you and your wife got back together and you wanted to become the baby's father then you would have to go back to court and legally adopt the child.

    I would take a DNA test first to make sure (unless you don't want it regardless)
