My family is about to try and go to the judge and have me removed from my apartment and placed in a group home. Do they legally have this power?

  1. This is something you really need to research further - your state's laws. If you are into drugs and alcohol and are a problem or risk to yourself, then most likely they can.  You've heard of people being forced to check into a mental institution, it's basically the same thing

  2. Do you have a conservator or guardian?  At any hearing, you are entitled to be represented by an attorney free of charge.  Contact the Dept of Mental Health or your local public defender and ask for an attorney.

  3. I believe if they can prove that you are incompetent to take care of yourself, then they may be able to do that.  Or if they find that you pose a threat to yourself or others, that may be grounds for that too.

Have they said why they'd like to do this?  Surely they must have.  Would you care to share?

  4. If they get a doctor to say you should not be on your own..........yeah they can.

    Sorry

  5. It sounds like they really care about your well being if they are going to go through that to help you.  Maybe you could find an alternate way to alleviate their stress that something might happen to you.  Like a live in aid to ensure your needs are met.  If you are capable of taking care of yourself and just don't sounds like a no brainer just do it and prove to everyone that your freedom is important to you.

  6. If you want to talk just email me and I will see what I can do to help.  I have asperger's and social anxiety and depression too so  I am sorta on the same level as you and can probably understand your situation better.

  7. Yes, If the judge agrees.

You don't explain what happened, but parents normally do this when a minor child is "out of control", or doesn't respond to parental discipline.

Then, someone else, other than the parent has to take charge.

But,if you are legally an adult, I don't think they will succeed, unless they can introduce evidence that your are mentally incompetent.

Since you seem to type and spell well, better than most here, it seems likely they will fail doing this, especially if you can convince a judge you can make responsible decisions on your own.

Sorry, but it's worked before, and perhaps you should count your blessings, that your parents are willing to try "tough love."

  8. not if you are 18 or older .... or if the judge finds that you are a serious danger to yourself...

  9. if your under 18, then yes.... If not, NO!

  10. Why have you broken the law? not gotten good grades? Why would they do this to you? Are you on drugs?

Yes they do if you are under the age of 18, but just tell them that no matter what they say you aren't going. Unless they have just reason, otherwise if you are a trouble maker it would do you some good.

  11. Are you a danger to yourself or to others? What are their reasons? If they can convince a judge, it must be very bad.
