Im an unmarried over 21 guy is studying in the US under F-1 student visa. Im going back for an MBA. My father just applied for US Citizenship, I believe he applied for my green card earlier, how long i have to wait before I get my green card?

The second question is, if my dad gets his citizenship, do i get some kind of work permit while my green card is filed?

  1. the wait time is 6-7 years go do your MBA and then try and apply for a tem. visa and then wait till your green cad is aproved.

  2. American citizens certainly can file immigrant visa petitions for their adult children, whether single or married. Even green card holders can file for their unmarried adult children. In your case, your father's petition would fall in the F1 family preference category, but unfortunately the wait is fairly long. If you take a look at the Visa Bulletin available at http://travel.state.gov/visa/frvi/bullet... you'll see that it currently takes over 6 years for an F1 petition to become valid after it's filed, although for Filipinos and Mexicans the wait is much longer. At the moment, the priority date for most F1 petitions is 15 March 2002, ,which means that only petitions filed on or before that date are now current, or valid for use. Until a petition is current, it provides no immigration benefits.

Since your father is now a legal permanent resident, he could file a petition for you now, in the F2b category. Once he becomes a citizen, it would be upgraded to F1 and would retain the original file, or priority date. So, there's good reason to file before he becomes a citizen as otherwise, you'll lose however long it takes for him to actually become a citizen, if he waits to file then. If he does do that, he needs to inform USCIS about your petition so they can upgrade it, as they won't go look for it, unless you tell them to.

  3. You can't.  Parents cannot sponsor there ADULT children.  You are 4 years late.
