My father in law has passed away and we were told he left his insurance policy in the name of my husband and?

myself.

My husband is not capable of understanding this and Im not sure what we do to receive this or even find out if its a joke .

What do we do?

  1. Call the insurance company and ask who the beneficary is.  If it is you, claim it.  Easy enough.  Before you spend it.. check his will for his wishes.


  2. Who told you this?  The next of kin or executor of the estate would probably have access to his personal records.  That is where you would find any reference to a policy?

  3. Just call the insurance company. However, they generally do a really good job of noticing when someone dies. The funderal homes put the decedent's name into a database that notifies insurance companies and stops social security checks (really quick!). LIfe insurance pays directly to you, not the estate, so you do not need to deal with executors, probate, etc

  4. Who told you that? Whoever told you, if they know that, then they know where the policy is, or who the company is.

    If there is a life insurance policy naming you beneficiary, you have to call the company and ask for claim forms.

    But it could also be a joke.

  5. If there is a policy you'll need to file a death claim with the insurance company.

    If you go threw the policy you will see a section where it lists the beneficiaries.  There will be a primary and possibly a contingent beneficiary.

    A beneficiary is who receives the proceeds from a policy.  The primary beneficiary is first in line to receive the death benefit. If they are no longer alive themselves then it automatically turns over to the contingent.  Now if they are no longer around then you will need to file a next-of-kin type of paper work with the insurance company.

    To do this:

    1. You'll need a copy of the death certificate.

    2. A copy of the policy, however in most cases a policy number will be enough.

    3. Contact the insurance company or agent. I'd say use the company directly, they usually have a claims service at the home office and a toll free number.

    They'll walk you threw rest of the process.

    If you are not sure there was a policy then this becomes a whole different task and a fairly difficult one.  Start by going threw old papers, checking bank records for premium payments, and asking family members. If this is the case you'll have to do some detective work.

  6. If there is a next of kin, they will know who is executor of his estate. The executor will be able to tell you if this is so. If there is a life insurance policy in your husband's and yours name, you will need to request a copy of the death certificate to claim the benefits.

    See if he had a lawyer or will. Also try calling a few different life insurance companies, tell them the situation, see if they can suggest anything.
