Question:

My father was born in the UK in '36 and died in '88 in Aust, can my son & I have a British and Aust passort?

I am a female, my husband thinks that there may be a law which says that only the sons of British citizens may have passports. I was curious as to whther I could opbtain a British passport. My son was also curious as to whether he could obtain a British passport also.

  2. If your parent/parents have british birth certificates, then yourself and siblings ( males and femakles alike)can hold both a british and australian passport, duel citizenship. Having said that the child/children would be better off having the australian passport , if you only hold the british passport, you can leave australia, but it can be difficult obtaining a visa to re-enter australia. This was the information given to me when my son applied for a passport.

  3. I think where your husband got confused is that many years ago a passport and an ancestral visa (4 yr right of abode in the UK at the time) allowed it only through the fathers side.

    Even if you are unable to obtain one, your son would certainly be eligible for an ancestral visa to the UK.

  4. To my knowledge (and depends country to country) as long as the original citizen is in your immediate family (biological and either mother, father or grandparent) then you can obtian a 2nd passport.

    But beware, that means dual citizenship (citizen of both countries) so research that as well for what you may have to do as a dual citizen.

    Best bet would be to contact the British Embassey in Canberra and they can give you everything you need to know.

    I know two girls (20 and 24) who's mother was born in Croatia and they have to go to Croatia to pick up their passports and dual citizenship...you may have to do the same but as i said, it depends from country to country.

The British High Commission website has all the information you need.  There is no law that says only sons of British citizens may have passports, that is just ridiculous.  It depends on the year of birth and all children are eligible if they meet this criteria. I think 1986 (check the website) is the cutoff so, just guessing your age here, I think you would be eligible for dual nationality.

    I was born in 1948 of British parents, and I'm female, and I qualify for a British passport.

    I'm not sure about your son. If he doesn't qualify for a passport, he may well qualify for an 'ancestry visa' which gives him more scope for employment etc in the UK.

  6. Any children or grandchildren of a British born citizen can have both a British and Australian passport. Unfortunately, as your only related via marriage your husband is not entitled, your son however is. Gender makes no difference. So unless your husband too has British parents or grandparents your immediate family cannot hold both, but yourself and any children you have can.
