My fence,and neighbours and law?

I have a(it is mine) fence which I want to paint,I want to paint on the neighbours side as well.But I do not get along with the neighbours.Do I ask them permisson to paint on thier side of the fense.Can they say that I trespassed if I dont ask them even though it is my fence

  1. In the UK it is law that a neighbouring property has to give "reasonable access" to allow maintainence.


  2. Yes, even though its your fence, you would need their permission to go onto their property to paint their side of your fence!

It all depends on where you live.  In Maine the fence has to be 10 feet on your side of the property line.  If that is the same case in your location you will not be trespassing on their property.  Check with the local ordnance and see if you own property on the other side of the fence.  If not and you don't want to deal with your neighbors try painting from your side (you don't say how tall the fence is) maybe you can paint the other side without going on their property and then paint your side.   If that isn't a possibility then let your neighbor know you want to paint the fence on both sides and see if they mind if you come over and paint.   Good Luck.

  4. It may be your fence, but you'd be standing on their land to paint it on their side.

    I'd say you better ask.

Your fence is your responsibility to maintain however if you were to just walk on to next door then they would have to ask you to leave and explain to you they do not want you on their land it will only be trespass if you then return uninvited also if the rent the property you may like to ask the landlord for permission and not the tennant.
