My fiance's ex wife told him they were never legally married but guess what.?

She knew they were still legally married and knew he and I were going to be married next month. I insisted that he check with the courts since they already started divorce procedings two years ago. We went to the county recorders office and there was a marriage license filed comfirming their marriage. His ex wife called him not long after six months into their divorce and said she received everything back from the court with a letter saying they were never legally married and the preacher never mailed in their marriage license from the ceremony, so she lied. My question is she was not going to say a word and let us make fools of ourselves next month and get married is there anything that we can do legally to her since she was going to going to let him commit bigomy, without saying a word. She changed her name legally that is how I knew that it was impossible and that there was a marriage license filed.

  1. No.  It doesn't matter what she said, if she lied or if she was just mistaken.   Changing her name legally doesn't prove anything as far as I can see, but it's all beside the point.

    Your fiance is supposed to know the details of his own life and legal history.  He is supposed to pay attention to such things as filing marriage licenses and getting a proper divorce.

    His ex has no duty to keep track of this for him.


  2. You can only sue if there is damages.  In this case, there isn't. Being made a fool isn't damages.

    You got the husband she lost - let that be your victory and drop it.

  4. Sue her for what?  I doubt you could find an attorney to take the case as it seems baseless.  

    Did your fiancee ever receive divorce papers?  If so, he is divorced.  If not if he wanted a divorce why didn't he check with his attorney about it?  Your state's Dept of Vital Statistics can tell you if he is divorced.  They keep records of all marriages and divorces.

    You didn't give enough info for a better answer.

    The bottom line is that fiance is responsible for failing to make absolutely sure, himself, of what his legal status is, or was. She has no LEGAL responsibility to give him accurate legal information. That is what lawyers or self education is for.

    It is completely common for an ex to lie, or be ignorant of the facts, themselves.  

    If you say "6 months into the divorce".. you still don't seem to have followed through as to if that was actually filed, and what the result on that was.

    Your fiance was not going to commit bigamy.. he was (and still is) committing stupidity, by relying on what someone else tells him.  

  6.     You want to sue your fiance's wife, which is what she is, because he is not intelligent enough to know he never got a divorce decree from the courts?  That's rich.
