My fiancee is being deported what can I do to help him and are planning on getting married soon,?

i'm a US Citizen, what are the steps that you have to follow. He has been convicted of a felony due to excessive DWI's. Is he able to get a green card? Or would going through a lawyer help him more?

  1. you cant do anything. do not get married. if he is banned for 10 years you are stuck with an absent spouse you cannot do anything for.

    or you can leave USA and go live with him in his country until the ban has expired, and then petition for him legally.

As a convicted felon, he is not admissable to the US.  He is being deported and there is nothing whatsoever you can do to "help" him.  He can never return, never get a green card or anything else.  He has to go to his own country and stay there.  If he applies for your immigration to his country, you can join him there.

    As a deported illegal alien and convicted criminal, he's not likely to be able to immigrate to any other country either.

He should be taken out and caned or flogged on his bare azz in public and sent to jail for several years and then deported...You could go with him if you want...I suspect if he is a habitual DUI then you are better off without him He has a problem with alcohol and has no intention of getting help. He would destroy your life as well as his own.

  8. Hun,   you do not want to be with a man who he here illegally and a drunk. what happens when you have children ? what happen when he gets into the car with your child and kills it because he was driving drunk. run away from him as fast as you can and be thankful he is being deported.

  9. He will be banned for 10 years. If you want to see him you will have to join him in Mexico. If he comes back here he will go to prison.

    No way he is getting a green card now, he blew it.

  11. He should see if he can request voluntary departure.  The consequences against him are less severe if he leaves on his own.  If he forces ICE to actually deport him it will be almost impossible for him to come back in less than 10 years.

    Assuming he leaves on his own, you will have to file a fiance petition for him, or go to where he's at, get married, and come back and file a spouse petition for him.

    Due to his legal problems he's going to be rejected.  At that point he will need to file for a Waiver of Inadmissibility.  His chances of getting the waiver are not great.

    I suppose he's here illegally too since you didn't mention anything about him having a green card.  That's going to be another complication.

    Perhaps you should think about moving to his country with him and starting a life for yourself there.  That might be the only way you two can stay together.
