My fience visa has been returned for further review and i still waiting for the result.

Question

On july 27th 2007 my petition file for fience visa has been sent back from Indian embassy for further review . Untill now i have not heard anything from them. Now my lawler told me that i should go to India and get married and file all over again. But i don`t feel right to go through the process again rather i would like to get resolved this case as i have waited more than a year already. Please help me what to do.

Well, your lawyer has a point, because it's very unlikely USCIS will take any action on your K petition before it expires. Once it expires, that's the end of that petition. In that case,your choices would be very limited. File a new K petition, go to India and get married, and then file a new immigrant visa petition, or find a new fiancee. Of course, it you weren't able to show a valid relationship for the K visa, you may well have the same problem with the IR/CR-1. Plus, you'll end up waiting another year or more while USCIS processes your new immigrant petition. So, there are no quick and easy solutions here, only slow ones.
