My finacee has green card of US for how much time she can stay out side USA without affecting her status?

  1. 364 days at the most. she has to come back within 365 days other wise the green card would expire


  2. She has to be in the States for six months a Year.

  3. Less than a year without the filing of a special form as "returner". However she needs a residence in the States. And an explanation why she is abroad (No "other residence" abroad, otherwise they (the customs people) take her card)

If there is a demonstrated emergency that would require a person (fiancee) to retain their residence in the U.S. and travel out of the country and remain for up to 2 years, the person can go to the web site www.uscis.gov and use the Form I-131 located in the Immigration Forms section.  The form is for the person to obtain a reentry permit.  A common scenario for such a necessity would be for the lawful permanent resident to return to their home country to settle a family estate.

  5. She can go outside the US for up to 6 months.  She has to maintain a residence of the US.  If there is more then a 6 months residence gap she will loose her green card.

    I know this for sure as my husband has gone thru it.  We were out of the country for awhile and came back 3 days before his 6 months was up.  They were telling us that was too close and next time we should be careful and keep track of the time.
