My former employer failed to pay my wokman's comp. Should I sue them especially after it has ruined my credit?

I had a work related injury. Had surgery to repair a broken wrist. Looked at my credit report the other day and I see a $7000 bill from the hospital from 3 yrs back and this is after I had put in a wokrman's comp claim to their insurance. I think I should sue the pants off of them. Any suggestions/advice?

  1. Your first call should be to workers comp, to see why they haven't paid the bill.  If you were supposed to be covered, worker's comp is supposed to pay your bill, then go after your employer for the money.

If you were supposed to be covered, you may be legally barred from suing the employer as well, so no case could succeed.

  2.   yes of course sue the pants off of them ,,do it now  what are you waiting for ...go gettem tigar ,,,,,,p/s. get a lawyer...

  3. not sure. I'd grab an advising agent that can provide both lawyer and accountant to look at it and see how liable the former employer is. Then that way if you do need to sue, you can at least go in with all guns blazing and know what your doing.

  4. Sue them for what?

It's three years later, there are obviously no damages to be collected for.
