So school started a week ago, and there was already beef with my friend and this new guy at school. We're both in grade 10, and my friend didn't like him from the start and tried to make fun of him and just was being real hostile to him for no reason, and I said to my friend that he doesn't look like the guy you want to mess with.

So the guy finally said alright today, fight after school you're going to regret this, so my friend said okay sure bring it on I'll **** you up) (my friend is a big mouth and is only like 5'8 130 where this new guy is like 5'6 170 lbs and looks ilke hes on steroids.

so there was like 100 people all surrounding the fight and they started to brawl and the new guy was beating him pretty bad and had total control, and then my friend pulled out a knife out of his pocket and the new kid started raging and grabbed the arm he had the knife in and twisted it all the way back until he was on the grund and then kept punching his face until his teeth were broken, and at this time everyne was cheering for the new kid because my friend pulled a knife.

So now my friend is in the hospital with his arm broken and his teeth punched in, will he be able to sue this new kid, with witnesses like me around? I'm not sure if it was on the news yet but it probably will be eventually.

  1. No, you cannot sue for provoking a fight, bringing a weapon to it, and then losing. It would not be self-defense to keep punching way past the point of disarming him, but courts are not going to be sympathetic that a bully got his @ss handed to him by the new kid.

  2. serves your friend right for talking trash and being a bully...if anything the new guy could press charges for your so called friend pulling a knife out on him...when that moment occurred it became a matter of self defense for the new guy. Granted the "self defense" was probably taken alittle too far.But his point was made. Also im very surprised your friend wasnt arrested for bring a weapon on school property, nor suspended or expelled for that matter. In addition to my observation, my opinion of this is that all 3 of you are idiots who need to grow up before you enter the real world where none of your peers will be there "cheering" you on when someone is attacking you. Learn to handle your issues like an adult, quit picking on each other, and if you dont like someone, FINE you dont like them then just dont associate with them and if you do have to work with them in some way be civil. Go to your teacher and tell them you would lie to learn some common sense because you and your friends sem to lack it.

  3. Boo Hoo for your 'friend'.

Sounds like he got what was coming to him.

Maybe next time he'll keep his mouth shut and his teeth won't be handed to him on a silver platter.

    LOL

    Oh, and P.S.

Your 'friend' can't sue a person that was defending themselves against him.  Your pal just has to suck it up and take it like a man.

Oh, and here's just one more thought:

I just LOVE when the bullies get beat down.  I would have PAID to see your friend get his arm broken and his teeth knocked out.

    LOL!!

  4. No way the boy was defending himself. Your friend is very very stupid and deserved all of that!!!  What was he supposed to do? stand there and let your friend hit him and then knife him? no he defended himself. Sorry don't even try suing - seriously stupid and juvenile.  Tell your friend to take anger management classes - boys like him go on to be criminals and women beaters.

  5. Too bad for your friend.

No way he can be sued.  He was the one who brought the weapon.  Learn from your friends mistake.

  6. no i dont think he will b able to because your friend was

the one provoking him n the new guy was simply defending himself when your friend pulled out the knife

  7. A broken arm is unfortunate, but that kid had every right to do what he needed to do to save his own life.  Your friend is very, very lucky to be alive.  That kid could've killed him in self defense.  You might say your friend wouldn't have used the knife, but how does he know?  Nobody... nobody... would take that chance.

Not only would your friend be unsuccessful suing, there's a real strong possibility charges will be brought against him instead.  He should get a lawyer.  Huge huge thing he did, pulling out a knife.  Instead of looking to sue, he should also apologize profusely.  According to your story that kid was completely unprovoked and attacked on his first week of school.

You on the other hand, actually sound like a pretty nice kid.  There's humility and honesty in your post.  I'd ditch that friend, you dont need him.

  8. You seem to have a friend that does not have good sense.

FIRST:  He picks on someone that is bigger then he is

SECOND:  He chooses a battle that he does not know the strength

         or weakness of the opposition.

THIRD:  He chooses an approach that is meant to intimidate, in the

middle of a fight.  Once a fight starts intimidation does not work

          if you are loosing already.

I believe the other boy was wrong to do to you friend what he did, but

I know:  Once in a fight, proper reasoning is almost impossible to

    grasp.
