Question:

My friend got into a car accident!!!!?

He didn't have insurance....but he was at fault? The car he hit was a rental the people where visiting from New Jersey........What charges will he be liable for? Do they come after him directly as a driver? My friends car is all crashed from the front....the other vehicle only had a smashed bumper....We live in CA

  1. Hopefully, your friend will go to jail for driving without insurance and presenting fraudulent proof of insurance to an officer.

If he was at fault, then he is legally liable for all of the damage he caused, including any injury claims.   The other parties may file a claim under their own uninsured motorist coverage or the rental company's(not sure which policy would be primary), but he will still be required to pay back what was paid out.

  4. he is going to be in big trouble. He needs to get proper insurance right away. He will be fined for the invalid insurance and for the violation leading to the crash. He will also have to pay for damages done to the other vehicle because he doesnt have an insurance company to go after. Then as far as his car, that will also come out of his pocket to be fixed. Then he better hope the other people didnt get hurt or claim they got hurt because he will be paying for that too. Good Luck and hope this was a lesson learned.

  5. First of all, your friend is an irresponsible moron, but you already knew that.

    He will almost certainly be charged for driving without insurance, and then will probably get an additional charge for giving the cops fraudulent insurance information. The rental car will probably be covered from the insurance of the driver of it, either his/her own policy (under the uninsured driver part of the policy), or if they paid extra for the collision coverage. There is also a possibility that either the rental company or the insurance company will go after your friend to recover the losses, and there is also a possibility that the people in the other car could sue him.

    No matter what on all that, he is responsible for the damage to his own car.

    Hopefully your friend won't go to jail or get sued, and even more I hope he learned a lesson from his stupidity and is properly insured the next time he drives.

    He will get in a lot of trouble if they find him, showing a fake insurance card and all.

    Tell your friend to go get some REAL insurance, cuz he could have gotten his car fixed for a cheap price, now he can't.

  7. If he can't afford insurance, how will he afford to pay a lawyer? He probably gave a statement to the police on the spot. Talking is the first mistake. Tell him not to discuss the accident with anyone (in person or on the phone). Investigators will try to call him and ferret out info -  they're are very good at what they do.

    He really needs a lawyer.

    This is a prime example of WHY insurance is needed. Also, when accidents occur, the best thing to do is show your license give your address, phone and then SHUT UP.

  8. That's Funny ! Tell your friend that he should straighten it out ASAP or move to Mexico. He should call the police & ask'em where he needs to turn himself in.
