My friend has a warrant in illinois and got in trouble in oklahoma do warrants transfer???

he has a warrant for drug type stuff in illinois so had a outstanding warrant for a year... he went to oklahoma and got pulled over with 4 lbs of pot on him....do warrants transfer from state to state?? what is the expedition process?? do they know he has a warrant in illinois?

  1. No he will be sentenced in OK for his crime there and he will either do his time or be extradited to Illinois and then after that time served he will be extradited back to OK

    They do not transfer time has to be served where the warrant was issued


  2. No, warrants do not transfer.  But when this loser gets ready to get out of jail, the State of Illinois gets to extradite him to face the pending charges in Illinois.  Also, if he crossed state lines to avoid being prosecuted, it is in violation of federal law.

    A warrant that has not been served is called an "outstanding warrant."   When they pulled him over and found the pot they arrested him right then and there.   Then since they already have him in custody, they will run his name and the warrant from Illinois will show up.  Then it will be unlikely he will get bail as he already skipped out once and they will not trust him again.  Since Oklahoma has him they will try him.  If he is found guilty, he will serve his sentence in Oklahoma.   Then when that is done, they will ask Illinois if they still want him.  If yes,  Illinois will have to make the arrangements to pick him up.   Then he goes to Illinois and probably will not get bail there either.  They will try him and he will get to do his prison time there.  

    Your friend is a loser.  Dump him.

  6. speaking from an Illinois LEO perspective

    The warrant in Illinois would need to be a serious felony to get entered into the NCIC system - we generally will not deal with most felonies and enter the into the national system.

    If his warrant was in the NCIC system - he would know about it already and Illinois would be seeking a Governors warrant to seek his extradition.  Unless he had substantial amounts - it is doubtful Illinois entered it and Oklahoma would even know - nor do they care - there is nothing they can/will do about it.

  7. It is not expedition, it is extradition.  The Illinois warrant will turn up and after Oklahoma is finished with him, he will be shipped back to Illinois.

    PS.  You need to seek a different kind of friend.
