My friend have a F1 visa expired 15 years ago, is she eligible for Substitution labor certification? She has a good sponsor, she is well educated and she is overqualified for the job.

  1. She might be.....question/problem is: is she eligible for green card. Most likely not.


  2. I don't think so. Visas are not interchangable, especially if they are expired. Education and qualifications are a plus only if the employer can justify that there are no other Amercians who could fill in the position.**

  3. f1 visas don't expire like that. they are good for what is phrased as "duration of status". that means her visa may expire on the date indicated but her legal status will not...as long as she remains a student in good standing at the school she petitioned for.

    15 Years is a long time for school. Your friend is probably "out of status"/aka/ visa overstay/illegal alien.
